Quand faut-il engager une assignation au tribunal ?<\/h2><p style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>L\u2019assignation<\/strong> est une solution de dernier recours, apr\u00e8s avoir tent\u00e9 de r\u00e9soudre le probl\u00e8me \u00e0 l\u2019amiable. Avant de saisir le tribunal, le bailleur doit respecter certaines \u00e9tapes l\u00e9gales :<\/p><ol class=\"wp-block-list\"><li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>Relances amiables<\/strong> : contactez le locataire par t\u00e9l\u00e9phone, email ou courrier pour comprendre la situation et trouver un arrangement pour le <strong><a href=\"https:\/\/matuile.com\/media\/huissier-pour-loyers-impayes\/\">r\u00e8glement des loyers impay\u00e9s<\/a><\/strong>.<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong><a href=\"https:\/\/matuile.com\/media\/mise-en-demeure\/\">Mise en demeure<\/a><\/strong> : si le locataire ne r\u00e9agit pas, envoyez une lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception pour exiger le paiement sous un d\u00e9lai pr\u00e9cis.<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>Commandement de payer par huissier<\/strong> : cet acte, d\u00e9livr\u00e9 par un huissier, est obligatoire avant toute action judiciaire. Depuis la <strong>loi du 27 juillet 2023<\/strong>, le locataire dispose de <strong>6 semaines<\/strong> (pour les baux conclus apr\u00e8s cette date) pour r\u00e9gler sa dette ou proposer un plan d\u2019apurement. Pour les baux ant\u00e9rieurs \u00e0 cette date, le d\u00e9lai pour payer est de <strong>2 mois<\/strong>.<\/li><\/ol><div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div><p style=\"font-size:16px;font-style:normal;font-weight:100\">Si, malgr\u00e9 ces d\u00e9marches, le locataire ne r\u00e9gularise pas la situation dans le d\u00e9lai accord\u00e9, l\u2019assignation au tribunal devient n\u00e9cessaire.<\/p><div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div><h2 class=\"wp-block-heading\" id=\"Comment-se-d\u00e9roule-l\u2019assignation-au-tribunal-pour-loyers-impay\u00e9s-?\" style=\"font-style:normal;font-weight:700\">3. Comment se d\u00e9roule l\u2019assignation au tribunal pour loyers impay\u00e9s ?<\/h2><div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div><h3 class=\"wp-block-heading\" style=\"font-style:normal;font-weight:700\">a). Ce document doit contenir :<\/p><ul class=\"wp-block-list\"><li style=\"font-size:16px;font-style:normal;font-weight:100\">Les coordonn\u00e9es des parties (bailleur et locataire).<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\">Le montant des loyers impay\u00e9s et la p\u00e9riode concern\u00e9e.<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\">Les demandes du bailleur : r\u00e9siliation du bail, paiement des loyers dus, remboursement des frais, etc.<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\">La date, l\u2019heure et le lieu de l\u2019audience.<\/li><\/ul><div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div><p style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>L&rsquo;assignation au tribunal pour loyers impay\u00e9s<\/strong> doit \u00eatre notifi\u00e9e au pr\u00e9fet <strong>deux mois avant l&rsquo;audience<\/strong>. Ce dernier va saisir un organisme qui va \u00eatre charg\u00e9 d&rsquo;\u00e9tablir un diagnostic social et financier au cours duquel le locataire et le bailleur peuvent pr\u00e9senter leurs observations. Ce diagnostic vise \u00e0 apporter au juge des \u00e9l\u00e9ments sur le contexte, la solvabilit\u00e9 et la bonne foi du locataire.<\/p><div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div><h3 class=\"wp-block-heading\" style=\"font-style:normal;font-weight:700\">b) L&rsquo;audience devant le juge<\/h3><p style=\"font-size:16px;font-style:normal;font-weight:100\">Lors de l\u2019audience, les parties peuvent se faire assister par un avocat :<\/p><ul class=\"wp-block-list\"><li style=\"font-size:16px;font-style:normal;font-weight:100\">Le bailleur expose les faits et justifie sa demande avec des preuves (contrat de bail, relances, commandement de payer, etc.).<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\">Le locataire peut pr\u00e9senter sa d\u00e9fense, notamment en cas de difficult\u00e9 financi\u00e8re ou de litige concernant l\u2019\u00e9tat du logement.<\/li><\/ul><div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div><p style=\"font-size:16px;font-style:normal;font-weight:100\">Le juge examine les arguments des deux parties avant de rendre une d\u00e9cision.<\/p><div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div><h3 class=\"wp-block-heading\" style=\"font-style:normal;font-weight:700\">c) La d\u00e9cision du tribunal<\/h3><p style=\"font-size:16px;font-style:normal;font-weight:100\">Le tribunal peut :<\/p><ul class=\"wp-block-list\"><li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>Constater la r\u00e9siliation du bail<\/strong> (si une clause r\u00e9solutoire est pr\u00e9vue dans le contrat).<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>Prononcer une r\u00e9siliation judiciaire du bail<\/strong> si aucune clause r\u00e9solutoire n\u2019existe.<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\">Condamner le locataire \u00e0 <strong>payer les loyers en retard<\/strong>.<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>Accorder des d\u00e9lais<\/strong> de paiement jusqu&rsquo;\u00e0 <strong>3 ans<\/strong> au locataire pour r\u00e9gulariser sa dette (<strong><a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000047900019\">article 24 V de la loi du 6 juillet 1989<\/a><\/strong>). Pour cela, le locataire doit avec repris le paiement du loyer avant l&rsquo;audience et \u00eatre en capacit\u00e9 de rembourser sa dette.<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>Ordonner l\u2019expulsion du locataire<\/strong> et fixer les modalit\u00e9s de son ex\u00e9cution.<\/li><\/ul><div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div><h2 class=\"wp-block-heading\" id=\"Quels-sont-les-d\u00e9lais-et-frais-associ\u00e9s-?\" style=\"font-style:normal;font-weight:700\">4. Quels sont les d\u00e9lais et frais associ\u00e9s ?<\/h2><p style=\"font-size:16px;font-style:normal;font-weight:100\">Le temps n\u00e9cessaire pour obtenir une d\u00e9cision d\u00e9pend de la disponibilit\u00e9 des tribunaux : cela peut prendre plusieurs mois avant que l\u2019audience ait lieu.<\/p><p style=\"font-size:16px;font-style:normal;font-weight:100\">En ce qui concerne les co\u00fbts, les frais d\u2019assignation sont \u00e0 la charge du <strong>locataire d\u00e9faillant<\/strong> mais le <strong>bailleur<\/strong> doit g\u00e9n\u00e9ralement les avancer. Que faire apr\u00e8s la d\u00e9cision du tribunal ?<\/h2><p style=\"font-size:16px;font-style:normal;font-weight:100\">Si le tribunal ordonne l\u2019expulsion ou le paiement des dettes, l\u2019huissier de justice intervient pour ex\u00e9cuter la d\u00e9cision :<\/p><ol class=\"wp-block-list\"><li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>Il signifie la d\u00e9cision de justice<\/strong> : le locataire est inform\u00e9 du jugement.<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>Il proc\u00e8de \u00e0 l&rsquo;expulsion du locataire<\/strong> : si le locataire ne quitte pas volontairement les lieux, l\u2019huissier peut organiser son expulsion en respectant les d\u00e9lais et les r\u00e8gles l\u00e9gales.<\/li>\n\n<li style=\"font-size:16px;font-style:normal;font-weight:100\"><strong>Il recouvre les loyers impay\u00e9s<\/strong> : l\u2019huissier peut engager des mesures coercitives (<strong><a href=\"https:\/\/matuile.com\/media\/saisie-sur-salaire\/\">saisie sur salaire<\/a><\/strong>, s<strong><a href=\"https:\/\/matuile.com\/media\/saisie-sur-compte-bancaire\/\">aisie sur compte bancaire<\/a><\/strong>, etc.) pour r\u00e9cup\u00e9rer les loyers impay\u00e9s.<\/li><\/ol><div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div><p style=\"font-size:16px;font-style:normal;font-weight:100\">En conclusion, <strong>l\u2019assignation au tribunal pour loyers impay\u00e9s<\/strong> est une proc\u00e9dure incontournable lorsque les d\u00e9marches amiables et les commandements de payer n\u2019ont pas abouti. En respectant les \u00e9tapes l\u00e9gales et en constituant un dossier solide, le bailleur peut obtenir gain de cause.
